Notice of Public Opportunity: Cannabis Retail Store Business License Bylaw Revision

Smithers Town Council will review Business License Bylaw 1850 on Tuesday, January 8th, 2019, beginning at 6:30 pm in the Council Chambers of the Town Hall, 1027 Aldous Street, Smithers, BC.

Amendments to the Town of Smithers Business License Bylaw establish the baseline framework for issuing Town business licenses. Amendments include:

  • Adding definitions for “cannabis” and “cannabis retail store”;
  • Establishing a $250.00 annual business license fee;
  • Including text to clarify that a provincial retail license is required before a Town of Smithers Business License will be issued.

The proposed Bylaw 1850, if adopted, would allow for the Town of Smithers to issue cannabis retail store licenses in the downtown area of Smithers.

Town Council had given the First, Second and Third readings of the Bylaw on November 13th, 2018, and a Public Opportunity is set for the January 8th, 2019 regular meeting.

Anyone who believes they will be affected by any of the proposed bylaw is invited to submit verbal or written comment to Council for consideration. Written submissions must be received by 1:00 pm on Monday, January 7th, 2019.

Notice of Public Hearing: Cannabis Retail Zoning Bylaw Amendment R 18-07

Smithers Town Council will consider Zoning Amendment (R18-07) to permit Cannabis Sales within the Town of Smithers, on Tuesday, January 8th, 2019, beginning at 6:30 pm in the Council Chambers of the Town Hall, 1027 Aldous Street, Smithers, BC.

The Town’s Zoning Bylaw is the primary tool to regulate land-use zones in which cannabis can and cannot be sold. Amendments include:

  • Establishing a use category by creating definitions for “cannabis” and “cannabis retail sales”;
  • Adding “cannabis retail sales” as a permitted principal use in downtown zones (C-1, C-1A, C-1B).
  • Requiring a 150-metre minimum distance from schools.

The proposed Bylaw 1849, if adopted, would permit cannabis retail sales in the downtown area of Smithers.

When is a Zoning amendment necessary?
Zones regulate what land uses are permitted in the community and provides information such as where buildings may be located, density requirements, and standards for lot size, parking requirements and building height. A Rezoning is a process of changing one zone to another. When a development is proposed, including constructing new buildings or changing the types of activities that occur on a property, the owner must check the zoning regulations for that property. If the existing zone does not permit the proposed development then it is necessary to apply for a rezoning.

Notice of Development Variance Permit (4011 Highway 16)

Smithers Town Council will review Development Variance Permit Application (DV 18-10) for the property located at 4011 Highway 16, on Tuesday, December 11th, 2018, beginning at 6:30 pm in the Council Chambers of the Town Hall, 1027 Aldous Street, Smithers, BC.

The owner of the subject property, 7-Eleven Canada Inc, is intending to eruct four double-sided koala signs and eight number wedge signs, as part of the Synergy Gas Station located at the same site. The number wedge signs are regarded as ‘incidental’, and are exempted from sign regulations. Hence, the applicant, on behalf of the owner, is requesting to vary:

Section 7.1 of the Town of Smithers Bylaw No.1841 Sign Bylaw, by increasing the maximum number of permitted permanent signs from 2 to 4.

Approval of the application would enable the owner to erect the proposed signs adjacent to the existing pumps, and thereby, comply partially with the international site design guidelines of Synergy Gas Corporation.

Anyone who believes they will be affected by the proposed permit is invited to submit written comments to Council prior to the meeting and to attend the meeting. Written submissions must be received by 1:00 pm on the day prior to the meeting of Council.

Notice of Development Variance Permit (4235 First Avenue)

Smithers Town Council will review Development Variance Permit Application (DV 18-09) for the property located at 4235 First Avenue, on Tuesday, December 11th, 2018, beginning at 6:30 pm in the Council Chambers of the Town Hall, 1027 Aldous Street, Smithers, BC.

The applicant, owner of the subject property, legally described as Parcel A (Plan 9565) Block 138 District Lot 865 Range 5 Coast District Plan 1054 Except Part in Plan EPP71874, wants to rebuild an existing storage shed, which is attached to and partially located under the carport on the site. The exterior wall of the proposed shed is 0.30 metre from the property line; hence, the applicant is requesting to vary:

Approval of the variance application would enable the owner to rebuild the shed the same as the original structure.

The Meadows

The Meadows has 14 single bedroom units that are all self contained and wheelchair accessible. Two units are specifically designated as handicapped and have modifications to accommodate someone in a wheelchair.

The Smithers Community Services manages the building, and the provision of hospitality services which include social and recreation activities, meals, emergency response service, and housekeeping and laundry.

Northern Health Authority is responsible for the personal care aspect of the program, and BC Housing provides funding, monitoring of the society, and standards of care.
