Public Opportunity Notice: Development Variance Permit Application - 4086 Highway 16 A&W (DV21-02)
Smithers Town Council will consider Development Variance Permit Application (DV21-02) for the property located at 4086 Highway 16, at its Regular Meeting on Tuesday, April 13th, 2021, beginning at 6:30 pm, electronically via Zoom and Facebook.
The Applicant, A&W Restaurant Smithers, is proposing to vary the following sections of Bylaw No.1841 Sign Bylaw:
- Section 7.1(a), by increasing the number of freestanding signs from one to two;
- Section 7.7(b), by permitting the entire sign face to be internally illuminated;
- Section 8.5(a), by increasing the maximum permitted area from 10m2 to 15m2.
Approval of the Applicant’s request will enable A&W to replace its exiting Menu Board Sign located facing the drive-thru, with a new 4.59m2 Menu Board sign, approximately one-third larger than the existing sign.
Anyone who believes they will be affected by the proposed permit is invited to submit written comments to Council prior to the meeting. All written submissions must be received at the Town Office before 1:00 pm on Monday, April 12th, 2021. The relevant background information is available below or at the Town Office (1027 Aldous Street) Monday to Friday, excluding holidays, between 8:30 am to 4:30 pm. Attendance in person is currently not permitted due to the COVID-19 pandemic and Public Health orders. Livestreaming is available on the Town of Smithers Facebook Page.
A Development Variance Permit is an approval from Council to vary the bylaw regulation(s) of zoning, subdivision servicing, or non-conforming development approvals. If a project does not conform to a bylaw regulation, a variance is required. As part of the review process, letters are mailed to owners and tenants within a 60-m radius of the subject property advising of the application and opportunity to provide written comments to Council. If approved by Council, a Development Variance Permit is registered on title.
